1. Introduction
These Terms apply to your use of this website and any associated services, features, or content we make available. AppChurch Global Foundation is a 501(c)(3) nonprofit organization headquartered at 7220 Trade St, San Diego, California 92121.
Fourth Wave Coffee is a public table: we publish stories, a research brief on coffee and brain health, the American Smile documentary series, and a catalog of coffees roasted by independent shops. We do not operate those shops.
If these Terms conflict with any incorporated policies tied to the Services, the more specific controlling terms apply to the extent of the conflict.
2. Your use of the Services
Access and content availability
You may browse, view, and (where offered) download content on supported devices. Availability of features or content may vary by country or region. Some materials originate from third parties (roasters, donation processors, video platforms). We do not endorse third-party content and are not responsible for it.
Age restrictions
Use of the Services is intended for individuals at least 18 years old. If you are a minor where you live, you must have a parent or legal guardian’s permission.
Third-party fees
You are responsible for any third-party charges (for example, data or carrier fees) incurred in connection with your access to the Services.
Information about you
Our Privacy Policy explains how we handle information. If you make a payment on a linked processor, that processor receives only what is needed to complete the transaction.
Misuse
You must not harvest user data, scrape personal data, overload the Services, bypass security, or use the catalog as an inventory API. Automated commercial scraping to train a model requires written permission.
Changes to these Terms
If these Terms change, notice may be posted on this page. Continued use after the effective date indicates acceptance of the updated Terms.
3. Payments, donations, and “Buy”
This site does not process card payments for third-party coffee bags. When you choose Buy, you leave this site and purchase from the roaster or donation form they operate. That shop’s or processor’s terms apply once you leave.
Legacy 1892 coffee is offered as a suggested donation to support preservation of historic trees. It is not for resale. Gift bags are limited by harvest. Donation processors (including Zeffy) have their own terms.
Pricing and availability on linked shops may change before you complete a transaction. You are responsible for any applicable taxes required by law. Unless a processor states otherwise at checkout, sales and donations may be final.
If a linked shop’s cart fails, that shop’s terms apply. We will correct honest catalog errors when we learn of them.
4. Rights and restrictions
License to use
Subject to these Terms, you receive a limited, non-exclusive, non-transferable right to access and use the Services and content for personal, non-commercial use. All rights not expressly granted are reserved to AppChurch Global Foundation or the named rights-holders.
Whose words and pictures
Quotes remain the words of the people named. Product photos and descriptions belong to their shops unless marked Legacy 1892. American Smile stills belong to the series. Do not scrape this site to train a commercial model without written permission.
Restrictions
You agree not to:
- Publicly perform or display protected content except where legally permitted or expressly allowed.
- Sell, rent, redistribute, broadcast, sublicense, or transfer content except where expressly permitted.
- Attempt to bypass security features or access controls.
- Remove watermarks, ownership notices, labels, or other legal notices.
Where third parties license content used within the Services, those licensors may be intended beneficiaries only for provisions that directly concern their content.
5. Health copy is not medical advice
Coffee is food. Pages under Coffee&Health are educational. They are not a diagnosis, treatment, or promise. Pregnancy, heart-rhythm issues, reflux, anxiety, and sleep disorders are reasons to ask a clinician before leaning on caffeine. Community screening programs are not a substitute for clinical care.
6. Conduct and community posting
If the Services allow comments or messages, keep posts relevant and readable. Do not post hate or harassment, sexually explicit content, profanity, impersonations, private or confidential data, spam, affiliate codes, or fake reviews.
Content or features may be removed or become unavailable (for example, if rights are lost, a service is discontinued, or for security or legal reasons).
The Services are not designed for hazardous or high-risk systems where failure could lead to severe harm.
7. Warranties, liability, and indemnification
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, AppChurch Global Foundation disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, AppChurch Global Foundation is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services or from linked third-party shops.
You agree to indemnify and hold harmless AppChurch Global Foundation and its officers, employees, and volunteers from claims arising out of your misuse of the Services or your violation of these Terms.
8. Binding arbitration
“Disputes” include controversies relating to the Services, related software, pricing, communications, transactions, or any term of this Agreement under various legal theories, excluding certain intellectual-property rights matters.
Notice and small-claims option
Before starting arbitration, each party agrees to give written notice describing the dispute, prior resolution efforts, and requested relief, using the Contact page. Small Claims Court may be available if you qualify.
Procedure and fees
Unresolved disputes proceed to arbitration administered by the American Arbitration Association under its commercial rules, typically in the federal judicial district of your primary residence or business location, before a single arbitrator. The arbitrator issues a written decision and may award allowed remedies; awards may be enforced in court.
If you cannot afford arbitration costs, AppChurch may advance costs subject to the arbitrator’s determination; for disputes above $75,000, AAA rules govern fee handling. If these Terms conflict with AAA rules, these Terms govern.
Class-action waiver, time limit, severability
You and AppChurch Global Foundation agree to resolve disputes only on an individual basis. Claims must be filed in Small Claims Court or noticed for arbitration within one year of when the claim could first be filed, or the claim may be barred. If parts of this section are found unenforceable, the invalid parts are severed and the remainder continues to apply.
9. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration agreement. Exclusive venue for any matter not subject to arbitration is the state or federal courts in San Diego County, California.
